The Condo Bar Real Estate

Privacy Policy

Effective September 28, 2026

This policy explains how Miko Nalepa, REALTOR®, operating as The Condo Bar with Right At Home Realty, Brokerage (“we”, “us”), handles personal information collected through thecondobar.com and the services offered on it.

We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL), and the obligations that apply to us as an Ontario real estate registrant under the Trust in Real Estate Services Act (TRESA) and the rules of the Real Estate Council of Ontario (RECO), the Toronto Regional Real Estate Board (TRREB) and the Canadian Real Estate Association (CREA).

The brokerage of record for all real estate services described here is Right At Home Realty, Brokerage. Records relating to a real estate trade are held by the brokerage as required by TRESA.

1. Information we collect

a. Information you give us. When you create an account, we collect your email address and, if you provide them, your first and last name, phone number and an optional additional email address. If you set a password we store it only as a salted hash held by our authentication provider; we never see or store it in readable form. If you sign in with Google we receive your Google account email address and basic profile details (name and profile image) — we do not receive your Google password.

When you contact us, request a property evaluation, ask about a listing, or submit a tour request, we collect the name, email address, phone number, dates and times, and any message or notes you choose to include, together with the listings the request concerns.

b. Information created as you use the site. When you are signed in we record activity tied to your account: the listings you view, searches you run, listings you favourite, saved searches you create, sign-ins, and messages you send us. We store your saved searches (including their criteria and alert schedule), your favourited listings, and the date each was saved.

c. Notes we keep as your agent. If you become a client, we may record working notes about your requirements — for example the type of property you are looking for, the areas that interest you, and where you are in a purchase, sale or lease. These notes are personal information about you and you may request access to them under section 8 below.

d. Technical information. Our hosting provider records standard web server logs, which include IP addresses, browser and device type, and the pages requested, for security and reliability purposes. The site’s own activity records described in (b) do not include your IP address.

f. Analytics and ad measurement. We use Google Analytics, Microsoft Clarity, Statcounter, Microsoft Advertising (Bing) and Meta (Facebook) to understand how the site is used and whether our advertising works — for example, how many visitors viewed a page or submitted a form. These tools receive your IP address, browser details and the pages you view. No names, email addresses or phone numbers are sent to Google Analytics.

When you sign in, or submit a form with your contact details, we also send your email address, phone number, name and account number to Meta in hashed form: scrambled into a code that cannot be turned back into the original. Meta uses it only to match site visits to Facebook or Instagram accounts, so we can measure how our ads perform. We do not send the contents of your messages or your searches. You can turn this off as described in section 2.

e. MLS® listing information. Property information shown on this site is supplied by TRREB through the PropTx data feeds and remains the property of TRREB and its members. It is listing information, not information about you, and we display it in accordance with our IDX and VOW agreements.

2. Browser storage, and what we keep before you register

We use cookies that are needed for the site to work — keeping you signed in, protecting forms against abuse, and remembering display preferences. We also use cookies for the analytics and ad measurement described in section 1(f), including one that holds the contact details you gave us so they can be hashed and sent to Meta. Signing out deletes that cookie.

You can block or delete cookies in your browser settings, or use the Google Analytics opt-out add-on. To control how Meta uses information about you for ads, see your Facebook ad preferences. Blocking cookies does not stop the site from working, though you will need to sign in again.

We also use your browser’s local storage to remember, on your own device: the listings you have recently viewed, any properties you have added to a tour list, and display preferences such as mortgage calculator settings. While you are not signed in this information stays on your device, is not transmitted to us, and is not connected to your identity.

If you later create an account, the list of listings you viewed on that device — and the listing you were viewing when you registered — is added to your account’s viewing history. We use it so that your saved searches and the recommendations we make reflect what you were already looking for, rather than starting from nothing. You can clear this information at any time by clearing your browser’s site data, and you can ask us to delete the history held on your account under section 8.

3. Why we use your information

  • To create and operate your account, and to authenticate you when you sign in;
  • To run your saved searches and send the new-listing alerts you have asked for, on the schedule you chose;
  • To respond to your enquiries, tour requests, evaluation requests and messages;
  • To provide real estate services to you as a client, including recommending properties that match your stated requirements;
  • To verify that you are a registered user entitled to see sold and leased data under our VOW agreement (section 5);
  • To protect the site and our users against fraud, spam and abuse;
  • To understand how the site is used and measure whether our advertising works (section 1(f));
  • To meet our legal, regulatory and brokerage record-keeping obligations.

We rely on your consent for these uses. You gave express consent when you created an account or submitted a request; you may withdraw it at any time as described in section 8. Some uses continue after withdrawal only where the law requires us to keep records.

4. Email, and how to stop it

We send two kinds of email. Transactional messages relate to something you did — setting your password, confirming a tour request, or replying to an enquiry. Commercial messages include the new-listing alerts for your saved searches and any market updates we send you.

Every commercial message contains a working unsubscribe link that does not require you to sign in, and that link stays valid for at least 60 days after the message is sent. Using it stops all commercial email to your address, not just the one alert it came from, and takes effect immediately. You can also reply to any message, or write to the address in section 12, and we will action it. Unsubscribing does not delete your account, your saved searches or your favourites — it only stops the email.

5. Sold and leased data (VOW)

Parts of this site operate as a Virtual Office Website under an agreement with TRREB. Sold and leased price information and full listing photo galleries are available only to registered users who have accepted the VOW Terms of Use. We record the date and time you accepted those terms so we can demonstrate compliance with that agreement.

That information is provided for your own bona fide interest in buying, selling or leasing real estate, and may not be used for any commercial or other purpose. We may suspend access where an account appears to be used outside those terms.

6. Who we share it with

We do not sell your personal information, and we do not share it for anyone else’s marketing. We disclose it only as follows.

Service providers. We use a small number of providers to run the site, each handling only what their function requires, under contractual obligations of confidentiality and security:

  • Supabase — user accounts, authentication and the application database;
  • Render — application hosting and server logs;
  • Google — sign-in with Google (where you choose it), reCAPTCHA to protect our forms from automated abuse, Maps to display property locations, and Gmail to deliver our outgoing email;
  • Cloudflare — site security and delivery, and the service that sends analytics and ad-measurement data to the providers below;
  • Google Analytics, Microsoft Clarity, Statcounter and Microsoft Advertising (Bing) — site analytics and ad measurement, with no names, email addresses or phone numbers;
  • Meta (Facebook) — ad measurement, including the hashed contact details described in section 1(f);
  • PropTx / TRREB — the MLS® data feeds that supply listing information to the site.

Our brokerage. We share information with Right At Home Realty, Brokerage where it is needed to provide brokerage services to you and to meet the brokerage’s record-keeping obligations under TRESA.

Others, where required. We may disclose information where required by law, regulation, court order or a regulator such as RECO, or where necessary to establish or defend a legal claim.

Storage outside Canada. Your account information and the records described in this policy are stored in the United States: our database and authentication provider, Supabase, holds them in its US East (Ohio) region, and our hosting and email providers also operate from the United States. While personal information is in another country it is subject to the laws of that country, and may be accessible to its courts, law enforcement and national security authorities under lawful process, without notice to you. We use providers that contractually commit to protections comparable to those required in Canada. If you would prefer your information not be stored outside Canada, please contact us before creating an account — we will not be able to offer the online services described here, but we can work with you directly instead.

7. How long we keep it

We keep your account information, saved searches, favourites and activity history for as long as your account exists. If you ask us to delete your account, we delete it and its associated records, except where we are required to retain them.

Where information forms part of a real estate trade record, TRESA requires the brokerage to retain it for at least six years after the transaction or the last activity on the file, and we cannot delete it before then. Records of unsubscribe requests are kept as long as necessary to honour them.

8. Your rights

You may ask us to: give you access to the personal information we hold about you and tell you how it has been used and disclosed; correct anything inaccurate or incomplete; delete your account and its history; or withdraw your consent to any use described above, including by unsubscribing from email.

Write to [email protected]. We will respond within 30 days, and will tell you in advance if a request would be subject to a fee. We may need to verify your identity before acting on a request. If you are not satisfied with our response, you may complain to the Office of the Privacy Commissioner of Canada at priv.gc.ca.

9. Security

We protect your information with encryption in transit (HTTPS), password hashing, row-level access rules in our database that prevent one user’s records from being read by another, restricted administrative access, and rate limiting on sign-in and form submissions. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach creates a real risk of significant harm to you, we will notify you and the Privacy Commissioner as required by law.

10. Minors

This site is intended for adults engaging in real estate transactions. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

11. Changes to this policy

We may update this policy as the site or the law changes. The effective date above will always reflect the current version. Where a change materially affects how we use information you have already given us, we will tell you by email or a notice on the site before it takes effect.
